READ THESE CONDITIONS CAREFULLY
The present General Conditions will expressly regulate the relations arising between MOTO STOCK SL, Sant Isidre street s / n, 08470 Sant Celoni (Barcelona) and with CIF B65212946 (hereinafter, "MOTO-STOCK") and third parties (hereinafter, "Users ") that register as users and / or acquire products through the online store of the MOTO-STOCK official website (www.moto-stock.com), hereinafter the" Store ").
2. USER OBLIGATIONS
2.1 The User undertakes, in general, to use the Store, to acquire the Products and to use each of the services of the Store diligently, in accordance with the law, morality, public order and the provisions of these General Conditions, and must also refrain from using them in any way that could prevent, damage or deteriorate the normal operation and enjoyment of the Store by Users or that could injure or cause damage to the property and rights of MOTO-STOCK, its suppliers, Users or in general of any third party.
3. PRODUCTS AND PRICES
3.1 MOTO-STOCK reserves the right to decide, at any time, the Products that are offered to Users through the Store. In particular, MOTO-STOCK may at any time add new Products to those offered or included in the Store, understanding that unless otherwise provided, such new Products shall be governed by the provisions of these General Conditions. Likewise, MOTO-STOCK reserves the right to stop providing or facilitating access and use at any time and without prior notice of any of the different kinds of Products offered in the Store.
3.2 The Products included in the Store will correspond in the most reliable way possible allowing the web display technology to the Products actually offered. The characteristics of the Products and their prices appear in the Store. The prices indicated in the Store are in Euros and include VAT, unless otherwise indicated or typographical error. Once the order is formalized, MOTO-STOCK reserves the right to validate it, in the event of typographical error in the price, availability, or any other reason beyond the control of MOTO-STOCK.
3.3 MOTO-STOCK is not responsible for the published prices, during the updating and maintenance functions of the website.
3.4 MOTO-STOCK reserves the right to change any product discontinued by the model with which the brand replaces it.
4. PROCEDURE AND FORM OF PAYMENT OF THE PRODUCTS
4.1 Within a maximum period of twenty-four (24) hours, MOTO-STOCK will send an email to the User, confirming the purchase. Said e-mail will assign a reference code of the purchase, and will detail the characteristics of the Product, its price, the shipping costs and the data of the different options to make the payment of the Products to MOTO-STOCK.
4.2 The User who purchases a product through the Store must make the payment through the payment systems specifically detailed in the Store.
4.3 MOTO-STOCK will file the electronic documents in which the contract is formalized, sending a copy to the User once the purchase is made. The contract will be made in the Spanish language.
4.4 The confirmation of the order sent by MOTO-STOCK is not valid as an invoice, only as proof of purchase. MOTO-STOCK will send the corresponding invoice to the Product.
5. RIGHT OF WITHDRAWAL
5.1 The user has a right of withdrawal by which you can contact MOTO-STOCK via email at the following address: info@moto-stock.com and desist from the purchase in a period not exceeding seven (7 ) business days, counted from the receipt of the Product. The Product must be sent together with the return form duly completed and a copy of the delivery note or invoice, duly completed, with MOTO-STOCK paying the direct cost of returning the Product. Said refund shall be made in accordance with the instructions that MOTO-STOCK indicates to the User in response to his notification of the exercise of withdrawal. The User must return the Product within a maximum period of seven (7) days after MOTO-STOCK indicates the return form.
5.2 Withdrawal entails the return of the amount paid. To do this, the customer must indicate on the return page the number and the holder of the credit card to which XX must make the payment. The term for said payment shall be that established in the Law.
6. CUSTOMER SERVICE
6.1 For any incident, claim or exercise of their rights, the User may send an email to the address info@moto-stock.com.
7. HOME DELIVERY SERVICE
7.1 The territorial scope of sales through the Shop is exclusively for the territory of the European Union, so the delivery service will only be for that territory. The Products purchased through the Store will be sent to the delivery address indicated by the User once the payment has been verified, with the maximum term of delivery being thirty (30) days established by default in the Law.
7.2 The MOTO-STOCK delivery service is carried out in collaboration with different logistics operators of recognized prestige. Orders will not be served in PO Boxes or hotels or other non-permanent addresses.
7.3 The cost of the shipments is not included in the price of the Products. At the time of purchase of the Product, the User will be informed of the exact shipping cost.
8. INTELLECTUAL AND INDUSTRIAL PROPERTY
8.1 The User acknowledges that all the elements of the Store and of each of the Products, the information and materials contained in them, the brands, the structure, selection, arrangement and presentation of their contents, and the computer programs used in in relation to them, they are protected by intellectual and industrial property rights of MOTO-STOCK itself or of third parties, and that the General Conditions do not attribute to it any intellectual or industrial property right other than those specifically contemplated in the same.
8.2 Unless authorized by MOTO-STOCK or, where appropriate, by the third-party holders of the corresponding rights, or unless this is legally permitted, the User may not reproduce, transform, modify, disassemble, reverse engineer, distribute, rent, lend, make available, or allow access to the public through any form of public communication of any of the elements referred to in the previous paragraph. The User must use the materials, elements and information accessed through the use of the Store solely for their own needs, being obliged not to directly or indirectly commercially exploit the materials, elements and information obtained through the same.
8.3 The User must refrain from circumventing or manipulating any technical devices established by MOTO-STOCK or by third parties in the Store.
9. DATA PROTECTION
9.1 In compliance with Law 15/99 LOPD, we inform you that your personal data and other information provided through the registration form, as well as that from the transactions made, will be included and kept in a file for processing, property of MOTO -STOCK, as long as its cancellation is not requested. The treatment will be destined to the development and execution of the sale, the personalized attention of the products and services that it acquires and to the improvement of said attention, as well as to the promotion of own products and services and of third companies linked to MOTO-STOCK.
Also, you are informed that your data will be made available to companies for the purposes indicated. MOTO-STOCK will treat these data with the utmost confidentiality being the sole and exclusive recipient thereof, and not making assignments or communications to third parties outside those indicated by current regulations.
The user expressly authorizes to MOTO-STOCK the remission, including through electronic means, by MOTO-STOCK and the aforementioned entities, of commercial communications and offers and promotional contests.
9.2 The User may exercise at any time the rights of access, rectification, opposition or cancellation by contacting MOTO-STOCK, C /. Sant Isidre s / n - 08470 Sant Celoni (Barcelona) or by email to info@moto-stock.com, attaching a copy of your N.I.F. or substitute identification document.
9.3. The answers marked with * in the registration form are mandatory. Your non-response will prevent you from making the purchase of the selected products.
10. PASSWORDS
10.1 MOTO-STOCK will facilitate the use of personal passwords to the user who registers as such on the website. These passwords will serve to access the services provided through the Website. The user must keep under his / her sole responsibility the passwords in the strictest and absolute confidentiality, assuming, therefore, all damages or consequences of any kind arising from the breach or disclosure of the secret. For security reasons, the password for telematic access to the services linked to the Website may be modified at any time by the user. The User undertakes to notify MOTO-STOCK immediately of any unauthorized use of his password, as well as access by unauthorized third parties to it.
11. COOKIES
11.1 MOTO-STOCK uses cookies in order to improve their services, facilitate navigation, maintain security, verify the User's identity, facilitate access to personal preferences and follow their use of the Store. Cookies are files installed on the hard disk of the computer or in the memory of the browser in the folder preconfigured by the operating system of the User's computer to identify it.
11.2 If the User does not want a cookie to be installed on his hard disk, he must configure his Internet browsing program to not receive them. Likewise, the User may destroy the cookies freely. In case the User decides to deactivate the cookies, the quality and speed of the service may decrease and, even, he will lose access to some of the services offered in the Store.
12. APPLICABLE LAW AND JURISDICTION
These general conditions are governed by Spanish law. Any controversy arising from the interpretation or execution that may arise in relation to the validity, interpretation, compliance or resolution of this contract shall be subject to the Jurisdiction and Jurisdiction of the Courts and Tribunals of the City of Sant Celoni, waiving any jurisdiction that may correspond to the User, provided that the applicable legislation so permits.
